EU's Court and Commission Topple Member Governments

A question asked in the EU's parliament (the Consultative Assembly) on Wednesday 30th Nov., sounded alarm-bells, which should have been ringing for weeks - ever since 13th September, at least - when the European Court of Justice (ECJ) ruled that the EU could force member-governments to impose criminal penalties, on their own territories, for breaches of EU-law.

The question, tabled by the parliament's Socialist, LibDem and Green groups, gleefully asked the Commission to confirm its interpretation (of the ECJ ruling) which said: "the Commission welcomes the Court of Justice judgement, because it recognises the exclusive competence of the Community to adopt criminal-law measures to ensure the effectiveness of Community law." [emphasis added]

This means that British courts will have to apply EU-law - and the penalties set by Brussels - without any approval from Parliament.

The Court's judgement had been wrapped up in complex language and camouflaged with "green issues" - and the Commission's interpretation was only published in obscure EU-records - but, when this question was read out in the Brussels-parliament, UKIP-MEP, Gerard Batten (London) at once declared that the ECJ's ruling was "a judicial coup d'état".

"Not since the time of Henry VIII," he told the Assembly, "has any power, other than the British Crown, possessed the right to create criminal offences, in Britain, and set penalties for breaking them."

"80% of new laws come from Brussels already, but only with Parliament's consent and carrying the penalties Parliament decides."

"This judgement means direct rule by the EU."

EU-Constitution, by stealth

The question also revealed the Commission's view that "Community-law has primacy over Union-law". This means that anything decided by the "Community-institutions" (Council, Commission, Assembly and ECJ) now takes priority over the EU-treaties, which member-governments signed and ratified - in some cases, by referendum - so that the terms of the treaties can be changed, and the discredited EU-constitution can be imposed, against the wishes of most Europeans, at the whim of Brussels-institutions.

"They don't call it that," Mr Batten said, "but parts of the EU-constitution have already been introduced by stealth."

"It's been too quiet," he went on, "everyone should have realised that the Commission's so-called "Period of Reflection" [after the constitution's defeat in France and Holland] was just a ruse - it's obvious now, what they've really been up to, all these months."
